The petitioner seeks bail in connection with Chapra Town P.S. Case No. 288/2020 instituted for the offences under Section 379 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 27.06.2020, charge-sheet has been submitted in this case.

Learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that on 20.05.2020 at about 5.30 pm when he parked his motorcycle in the market and went to purchase medicines and when he returned, he found his motorcycle missing.

No.36488 of 2021(2) dt.06-12-2021 2/2 Learned counsel for the petitioner submits that the petitioner is not named in the FIR, on the basis of confessional statement of co-accused, namely, Vicky Gupta, the name of the petitioner has transpired during investigation, further no incriminating articles have been recovered from the possession of the petitioner.

Learned APP for the State opposes the bail application.

Considering the facts aforesaid, the petitioner, above named, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S.
