JUSTICE SATYAVRAT VERMA ORAL ORDER 06-12-2021 Learned senior counsel for the petitioner seeks permission to correct the name of the petitioner to read as Sikandar Kumar Singh instead of Sikandra Kumar Singh as has been typed in the cause title. Permission is accorded. Heard learned senior counsel for the petitioner and learned counsel for the State.

Petitioner seeks bail in connection Bhabua P.S. Case no. 126 of 2021 registered for the offence punishable under sections 420, 467, 468, 471 of the Indian Penal Code read with section 66(D) of the I.T. Act.

Learned senior counsel for the petitioner submits that petitioner is in custody since 12.03.2021 and is person with clean antecedent and charge sheet has been submitted. Learned senior counsel for the petitioner further submits that from

Patna High Court CR. MISC. No.36467 of 2021(2) dt.06-12-2021 2/3 perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that he received Memo dated 11.3.2021 from the office of S.P., Kaimur along with memo dated 11.3.2021 from the office of Addl. S.P.,Kaimur.

Accordingly, investigation was conducted regarding allegation submitted by one Rajan Kumar Pathak for verifying veracity of the offer letter by Nisam Services private limited for the post of Data entry operator on contractual basis, it is alleged that during course of investigation, it transpired that organization was running in the name of Nisam Services private limited, further the premises where the office was situated was raided and during course of raid, it was found that two named accused persons were working in the office, one on the post of Director (petitioner) and other on the post of Coordinator. Further, it is alleged that it seems that accused persons with the help of computer used to cut and paste the documents and tried to cheat innocent unemployed youths.

He further submits that website is still there and it is visible from naked eye to all concerns and if the petitioner in any manner indulged in cheating the unemployed youth as alleged then the same would have been done secretly.

Learned APP opposes the prayer for bail.

No.36467 of 2021(2) dt.06-12-2021 3/3 Considering the facts that petitioner is in jail custody, charge sheet has been submitted and petitioner is a person with clean antecedent, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Bhabua P.S. Case no. 126 of 2021.
