07-10-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Raniganj P.S. Case No. 116 of 2020, corresponding to Special Case No. 285 of 2020, registered for the offence under Sections 30(a), 37(b)(c) of the Bihar Prohibition and Excise Act.

10 liters of country-made liquor is said to have been recovered from the house of the petitioner, which is said to be in joint possession.

It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. Nothing has been recovered from the conscious possession of the petitioner. It is stated in paragraph - 3 of the petition that petitioner has got

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Araria, in connection with Raniganj P.S. Case No. 116 of 2020, corresponding to Special Case No. 285 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
