JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-12-2017 Heard the parties.

This application, for grant of anticipatory bail, arises out of Dehri (Town) P.S. Case No. 241 of 2017, disclosing offences under Sections 147, 148, 149, 323, 341, 307, 353, 337, 338, 427 and 379 of the Indian Penal Code. There are nine persons named and several not named in the First Information Report, who are said to have committed the offence.

The informant is a constable. Allegedly, he was on patrolling duty in his bike. On an information that stones chips were being illegally transported in a tractor, he tried to intercepted the vehicle, whereafter, the accused persons came from nearby and attacked the informant and the other

Learned counsel for the petitioners has submitted that the allegation is general and omnibus and there is nothing specific against them.

Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas, in connection with Dehri Town P.S. Case No. 241 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
