The appellant is apprehending his arrest in a case registered under Sections147, 148, 149, 341, 323, 302, 326 of the Indian Penal Code and 3(i)(iii)( x )of SC/ST Act and Prevention of Witch practices Act, 1989.

Appellant is not named in the FIR and it appears that during investigation the name of the appellant has transpired. Submission of the learned counsel for the appellant is that even during investigation nothing has come against the appellant and he has been made accused only on the basis of statement of the witness.

Heard Special P.P. also, who has opposed pre arrest bail

Having heard both the sides and in view of the facts and circumstances of the case, let the above named appellant surrender in the court below within four weeks and pray for regular bail, which shall be considered by the court below on the basis of materials available on the records and if the submission of the appellant is correct he will be released on bail to the satisfaction of the court below otherwise Special Judge shall pass order or orders as he thinks fit and proper.
