JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 The petitioner seeks regular bail in connection with Jogbani P.S. Case No. 182 of 2017, registered for offences punishable under Sections 21(C ), 22 of NDPS Act and Sections 27(b),(ii) 28 read with Section 36 of the Drugs and Cosmetics Act.

Prosecution case is or recovery of spurious medicines and injections from the scorpio vehicle and driver was arrested there and petitioner is not named in F.I.R. later on his name transpired as the petitioner had a talk with the driver of vehicle earlier .

It has been submitted on behalf of the petitioner that that he is not named in the F.I.R. and save and except suspicion, there is nothing against the petitioner and he has been in judicial custody since 11.12.2018 and now chargesheet has been

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned learned Sessions cum Special Judge, Araria, in connection with Jogbani P.S. Case No. 182 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
