JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 452, 323, 324, 307 and 380/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the petitioners and other accused persons assaulted the informant by lathi and danda. Petitioners and others also dragged the informant and fired four rounds when one of the firing caused injury on the head of the informant. It is also alleged that the accused persons entered into the house and took away jewellery and `25,000/-.

It is submitted by learned counsel for the petitioners that petitioner no.1 is the cousin of the informant and petitioner nos. 2 and 3 are the full brother of petitioner no.1. In the background of

Patna High Court Cr.Misc. No.56215 of 2015 (2) dt.10-12-2015 2/2 land dispute, the accusation has been levelled. Wife of petitioner no.1 lodged Barbigha P.s. Case No. 25 of 2014 on 20.01.2014 and thereafter the present FIR has been registered. For the occurrence of 03.04.2015 at 12.30 PM, the FIR was lodged on 04.05.2015 at 12.15 PM.

Considering the delayed lodging of the case and the case lodged by the petitioner's side at earlier point of time, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sheikhpura in connection with Barbigha (Kewati O.P.) P.S. Case No. 151 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
