JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-04-2019 The petitioner claims compensation on the ground that an approach road along with Bridge has been constructed under Scheme NABARD for which work was initiated on 04.06.2016. Though the land belongs to the petitioner, he has not been paid any amount of compensation. In order to establish his claim over the land, he has brought on record photocopy of a part of continuous Khatiyan. In the continuous Khatiyan, the

The petitioner is seeking compensation in his individual capacity on the ground of he being the son of Mahanth Govind Das. The petitioner has not been able to make out his case on the basis of pleading on records that he himself is raiyat of the land, which is being utilized for public purpose. It goes without saying that if any land belonging to any other persons or trust is to be acquired/utilized by the State Government, such persons/trust shall be entitled for due amount of compensation under the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement act, 2013 or any other law applicable for such acquisition.

This application stands disposed of.
