====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-01-2022 Heard Mr. Ashok Kumar Singh, learned counsel for the petitioner and Md. Nazir Ansari, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Mali P.S. Case No. 127/20 registered for the offence punishable under 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

On the disclosure of co-accused Randhir Singh, the Police recovered 504 litres of illicit liquor from the filed of Kamlesh Pal. The name of the petitioner has been disclosed by Randhir Singh including one Ravi Singh. Learned counsel for the petitioner submits that the

No.36782 of 2021(2) dt.07-01-2022 2/3 petitioner has falsely been implicated in this case on the basis of disclosure made by co-accused Randhir Singh from whose identification, the illicit liquor has been recovered from the field of Kamlesh Pal. He next submits that other co-accused persons have been granted bail by co-ordinate benches of this Court in Cr. Misc. 16092 of 2021 and 28187 of 2021 respectively. The petitioner is in custody since 14.3.2021 and charge sheet has already been submitted. Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that other co-accused persons have been granted bail by co-ordinate Benches of this Court, the petitioner is in custody since 14.3.2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II cum Special Judge, Excise, Aurangabad, in connection with Mali P.S. Case No. 127 of

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
