The petitioner apprehends his arrest in connection with Janki Nagar P.S. Case No.68 of 2016 registered under Sections 302, 201 and 120(B)/34 of the Indian Penal Code, pending in the court of Sri Mithilesh Kumar, Judicial Magistrate, First Class, Purnea.
The accusation is that on 13.06.2016, the co-accused Nakul Mandal boarded the sister of the informant Laxman Yadav on a motorcycle on the pretext to go to her Maika but on the next day, her dead body was found in a field. The informant raised suspicion against the co-accused Nakul Mandal, Abhihandan
Patna High Court Cr.Misc. No.42055 of 2016 (4) dt.19-12-2016 2/2 Yadav, Ganesh Yadav and some unknown, who had land dispute, in committing the murder of his sister.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation the name of the petitioner has come in the confessional statement of the co-accused Nakul Mandal having his hand in the murder of the sister of the informant. Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the court below within six weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
