In the present writ petition, petitioner is challenging the order dated 8.8.2013 passed by the District Programme Officer, Purnea by which a direction has been issued for selection of respondent no.7.

Claim has been made that petitioner has been deprived of being appointed as Anganbari Sevika whereas respondent no.7 did not apply for the post nor she was called for

Patna High Court CWJC No.24239 of 2013 (3) dt.19-04-2016 counselling, has been appointed showing her physical disabled person. She approached to the District Programme Officer, Purnea but he has passed the order against the petitioner.

Being aggrieved by the aforesaid order she has filed an appeal before the Divisional Commissioner, Purnea which is pending for consideration.

In such view of the matter, this Court is not inclined entertain this writ petition in view of pendency of the aforesaid appeal. The Divisional Commissioner, Purnea is directed to decide the case on merit within a period of three months from the date of receipt/production of a copy of this order.

With the aforesaid observation this writ petition is disposed of.
