JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 19-01-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in a case under sections 304B/34 of the IPC.
Usha Devi, petitioner of Cr. Misc. No. 55847 of 2015, is mother-in-law whereas Deepak Kumar @ Champa Kumar
Patna High Court Cr.Misc. No.55847 of 2015 (3) dt.19-01-2016 2/2 Singh, petitioner of Cr. Misc. No. 57970 of 2015, is brother-in-law of the deceased.
Learned counsel for the petitioners submits that the deceased died due to accidental fire while she was cooking food. She was taken to Mayaganj Hospital, Bhagalpur from where she was referred to Sai Hospital Bokaro, where she was treated. It is further submitted that father-in-law of the deceased has already been released on bail and husband of the deceased is in custody. Learned counsel for the State, however, opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case, let the petitioners, as named above, in the event of arrest/ surrender be released on bail on furnishing bail bond of Rs. 5,000/- (five thousand) with two sureties of the lime amount each to the satisfaction of Sri Md. Shalim, Judicial Magistrate, 1st class, Bhagalpur in connection with Sabour (Gouradih) P.S. case No. 41/2015, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
