The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302 and 120(B)/34 of the IPC and Section 27 of the Arms Act. It is a case of murder of the informant's brother, namely, Vikash Kumar, by the accused persons by the gun shot while he was driving the motorcycle.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is no direct evidence against this petitioner and mere being a brother-in-law of Ranjit Bind, a mobile call was made between Ranjit Bind and this petitioner, because of this, the petitioner has falsely been implicated in this

Patna High Court CR. MISC. No.36510 of 2021(4) dt.13-04-2022 2/2 case. He further submits that para no. 64 of the case diary shows the call details as made between Ranjit Bind and this petitioner. He further submits that the SIM of that mobile in question is not in the name of this petitioner rather it belongs in the name of Punam Devi, wife of co-accused Ranjit Bind. Petitioner has clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Lakhisarai in connection with Kiul P.S.
