2. The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 21 of 2023, registered for the offences punishable under Sections 323, 498A, 506, 34 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.
3. As per allegation, the petitioner tortured the victim who is his wife, for non-fulfillment of demand of dowry.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He further submits that the petitioner has earlier filed a case for divorce on the ground of mental cruelty in the year, 2019 and thereafter, the present case has been filed. He further submits that the
Patna High Court CR. MISC. No.37652 of 2024(4) dt.20-08-2025 2/2 petitioner is continuously paying Rs. 13,500/- per month to his wife and he undertakes to continue the payment till any order of maintenance by the competent Court. The petitioner is a person of clean antecedent.
5. On the other hand, learned counsel for the informant has opposed the prayer for bail of the petitioner and submits that the petitioner has solemnized his second marriage and from the wedlock of second marriage, he has got two children.
6. Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XXV, Patna in connection with Mahila P.S. Case No. 21 of 2023, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023 with a further condition that the moment, the petitioner stops payment of maintenance, to which he has already given words, his bail bond shall be cancelled.
