JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-12-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 33 and 41 of the Indian Forest Act.
The accusation is of conducting illegal mining in the forest area and thereby causing loss to the tune of `19,50,000/- to the forest department.
It is submitted by learned counsel for the petitioners that mining operation was being conducted by valid settlement which was valid till 2013 when the case was lodged in the year 2011 and never any process was served on the petitioners. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with G.O. Case No. 242 of 2011 pending in the court of learned JM, 1st Class, Nawada. Accordingly, the application is disposed of.
