Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 307, 302, 504 of the Indian Penal Code. It is alleged that fourteen First Information Report named accused persons including the petitioners assaulted the husband of the informant, who succumbed to the injuries. It is submitted by the learned counsel for the petitioners that informant himself admits that specific accusation of assault is against Bilash Ram, Jitesh Ram and Sandeep Ram and there is omnibus and general accusation against the petitioners.
Considering the omnibus and general nature of
Patna High Court Cr.Misc. No.56339 of 2015 (2) dt.11-12-2015 accusation, it is a case for consideration of regular bail. Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Barachatti P.S. Case No. 482 of 2015, pending in the court of learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
With the above observation this application is disposed of.
