The Petitioner is apprehending his arrest in a case registered for the offence punishable under Section(s) 25(1b)a/26 of the Arms Act. One country made pistol was allegedly recovered from the shop of this petitioner.
Submission on behalf of the petitioner is that the petitioner was not present there at the time of alleged recovery. He had gone to attend the 'Saradh' of her mother-in-law. The petitioner had no knowledge of the aforesaid fire-arm or its recovery.
Considering the nature of allegation, I am not inclined to
Patna High Court Cr.Misc. No.52413 of 2016 (2) dt.07-12-2016 2/2 grant the privilege of anticipatory bail to the Petitioner in connection with Ramgarhwa P.S. Case No. 164 of 2014 pending in the Court of Sub-Divisional Judicial Magistrate, East Champaran.
The prayer is rejected.
