JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 04-06-2019 Petitioners, in the present case, are seeking a writ of mandamus directing the Bihar State Food and Civil Supply Corporation, Bhojpur to pay a sum of Rs.3,49,501/- with interest to the petitioners.
It is grievance of the petitioners that even though they have worked as Transportation Agents and have transported the paddy from PACS and also transported CMR supplied to the Bihar State Food and Civil Supplies Corporation Ltd., Bhojpur
Patna High Court CWJC No.8429 of 2019(2) dt.04-06-2019 2/3 in the year 2011-12, 2012-13 and 2013-14 on the approval and instructions of the government, they have not been paid their bills.
On perusal of the writ application it appears that the petitioners have annexed a communication as contained in letter dated 16.11.2015 written by the District Manager, BSFC, Bhojpur to the Chief Finance, BSFC Headquarter, Patna wherein he has requested the Chief Finance to make payment of the bills of the petitioner no.1.
In the nature of the grievance raised, without going into the merit of the contentions, this Court thinks it just and proper to direct the Chief Finance, Bihar State Food and Civil Supply, Headquarter, Frazer Road, Patna (respondent no.3) to look into the grievance of the petitioners, examine the same and in case it is found that the grievance of the petitioners is genuine and some admitted amount are to be paid to the petitioners for the work done the same must be paid within two months from the date of receipt/production of a cop of this order. It is made clear that this Court has not gone into the claim of the petitioners and it is for the respondent no.3 to consider the same independently on the basis of the materials available on the record.
