JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. Altogether seven persons including the petitioner were apprehended and one stolen motorcycle is said to have been recovered and furthermore, firearm and cartridges were recovered from possession of FIR named accused Raja Ram Yadav.

Submission on behalf of the petitioner is that having similar allegation co-accused Suraj Goswami has already been granted privilege of bail by a co-ordinate Bench of this court

Patna High Court CR. MISC. No.24591 of 2019(2) dt.17-04-2019 2/2 vide order dated 21.02.2019 passed in Cr. Misc. No. 10321 of 2019.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Bounsi P.S. Case No. 239 of 2018.
