The petitioner seeks bail in Motihari Rail P.S. Case No. 02 of 2013, instituted for the offence under Section(s) 395, 397, 412, 414 and 216-A of Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Silshad Ahmad @ Hafiz. Petitioner is in custody since 18.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.27746 of 2019(2) dt.29-04-2019 2/2 of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bettiah (West Champaran) in connection with Motihari Rail P.S. Case No. 02 of 2013, subject to the condition that both the bailors will be close relatives of the petitioner.
