The petitioner seeks pre-arrest bail in connection with Ghoshi P.S. Case No. 227 of 2015 registered under Sections 341, 323, 504, 379 and 307 read with 34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that as far as petitioner is concerned, there is no allegation that he assaulted the informant in any manner. He submitted that the petitioner happens to be agnate of the informant and on account of land dispute, a false and frivolous
Patna High Court Cr.Misc. No.11706 of 2018 (2) dt.27-02-2017 case has been instituted against him that he took away Rs.1500/- from the pocket of the informant. He further contended that the petitioner has no criminal antecedent and having got roots in the society, he is not likely to abscond or tamper with the evidence. Having regard to the nature of allegation and submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Ghoshi P.S. Case No. 227 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
