The petitioner seeks bail in Kurhani P.S. Case No. 83/2019, instituted for offence under Section(s) 413, 414/34 of the Indian Penal Code.
It is alleged in the written report that police intercepted one motorcycle on which three persons were sitting. Seeing the police party they started running away but on chase the driver of motorcycle was arrested, who disclosed his name as petitioner. He could not produce any paper with regard to motorcycle.
Learned counsel for the petitioner has submitted that petitioner has no concern with the aforesaid motorcycle. There is no any separate case lodged by anybody claiming the
Patna High Court CR. MISC. No.24803 of 2019(2) dt.22-04-2019 2/2 aforesaid motorcycle. Petitioner has been arrested in this case merely on suspicion.
Petitioner is in custody since 18.02.2019 having clean antecedent.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Muzaffarpur, in connection with Kurhani P.S. Case No. 83/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
