Petitioner is in custody in connection with S. Tr. No. 873 of 1999 arising out of Paliganj P.S. Case No. 04 of 1999 for the offence under sections 341, 323, 307, 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.
Learned counsel for the petitioner would submit that petitioner was granted bail on merit but his bail bond was cancelled on account of lack of pairvi.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
Considering the fact that petitioner has remained in custody for nearly 14 months and also considering the fact that
Patna High Court CR. MISC. No.41870 of 2019(3) dt.20-09-2019 2/2 earlier petitioner was granted bail, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-1, Danapur, Patna, in connection with Tr. No. 873 of 1999 arising out of Paliganj P.S. Case No. 04/1999 subject to the condition that petitioner shall extend full cooperation in early conclusion of trial. In the event, the petitioner fails to attend court proceeding on two consecutive dates without any cogent reason, the Court Below shall be at liberty to cancel the bail bond of the petitioner.
