2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a)/36 of the Bihar Prohibition and Excise Act.

3. 6 liters country made liquor was recovered from the place of recovery .

4. It is submitted that that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name transpired on the confessional statement of other co-accused persons. No incriminating material has been recovered from the conscious possession of the petitioner.

5. Learned counsel for the State submits that the

Patna High Court CR. MISC. No.34890 of 2023(2) dt.27-07-2023 2/2 huge number of liquor recovered from the conscious possession of the petitioner. It is further alleged that petitioner has got one criminal antecedent of similar nature.

6. Considering the facts of the case as also the fact that petitioner has got one criminal antecedent of similar nature , prayer for anticipatory bail is rejected.
