2. The petitioner apprehends arrest in connection with Muzaffarpur GRP P.S. Case No. 296 of 2023 dated 30.08.2023, instituted for the offence punishable under Sections 341, 323, 353, 506 and 504/34 of the Indian Penal Code.

3. The allegation against the petitioner, is that he along with other accused persons scuffled with police force and made an attempt to snatch their fire arms and created obstruction in discharge of their duty.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that there is no specific allegation against

It is submitted that petitioner was not present at the time of occurrence and he has been falsely implicated in this case only on mere suspicion that his house is nearby the alleged place of occurrence. It is further submitted that other accused persons have been granted bail by the lower court itself. Lastly, it has been submitted that he has two criminal case against him.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner in connection with Muzaffarpur GRP P.S. Case No. 296 of 2023, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge, Saran, subject to condition as laid down under Section 438(2) of the Cr.P.C..
