The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 504/506337/353/307/120B and other minor sections of the Indian Penal Code, Section 27 of the Arms Act and Sections 3/4 of the Prevention of Damage to Public Property Act.

Petitioner Meena Devi was a candidate for the post of Mukhiya and Petitioner Harendra Rai is her husband. Allegation is that during counting of the votes the petitioners committed assault and obstruction in discharge of the official duty of the authority. They further fired from the fire-arm. Submission of the petitioner is that there is no injury

Considering the nature of allegations, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan/Successor Court in connection with Marhowrah Police Station Case No.257 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
