The petitioner is apprehending his arrest in connection with Barbigha P.S.Case no.579 of 2017 registered for offences punishable under Sections 323, 341, 387, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and other accused persons is of threatening the informant as to why he deposed the case against him and one of the co-accused also fired and it is also alleged that he had earlier demanded rangdari also. It further appears that the petitioner is accused in three other cases also. Submission of the learned counsel for the petitioner is that there is general and omnibus allegation and nothing has been attributed against him.

Having heard both sides and in view of allegation as well as criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
