JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-02-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Jokihat P.S. Case No.286 of 2017 registered under Sections 448, 341, 323, 324, 325, 307, 379, 504 and 506 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that there is a case and counter case and most of the injuries sustained by the members of the prosecution party are

Patna High Court Cr.Misc. No.5764 of 2018 (2) dt.09-02-2018 simple. He submitted that the petitioners are close relatives of the informant and in the alleged incident several members from the side of the petitioners also sustained injuries. It is also submitted that the petitioners have got no criminal antecedent and having roots in the society, they are not likely to abscond or tamper with the evidence.

Regard being had to the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 286 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
