2. The petitioner seeks bail in connection with Dhanarua P.S. Case No. 111 of 2017 registered for the offences under Sections 395 and 397 of the Indian Penal Code.
3. The petitioner is not named in the F.I.R. and is in custody since 05.04.2024
4. As per FIR dacoity was committed by some unknown persons, where during the course of occurrence cash of Rs. 3,000/- and gold jewellery from the family members

5. Mr. Y.C. Verma, learned senior counsel appearing on behalf of the petitioner submitted that the name of petitioner transpired in the present case during the course of investigation out of confessional statement of co-accused Shiv Balak Kewat @ Shiwalak Kewat, in furtherance of which no incriminating material was recovered/surfaced as to connect petitioner prima-facie with the present occurrence of dacoity. It is also submitted as criminal antecedents of petitioner suggesting involvement in six more cases, for same reason also he was implicated with present case. It is further submitted that petitioner was not put on TIP as yet. It is also submitted that above named co-accused namely Shiv Balak Kewat @ Shiwalak Kewat & Raju Miyan have already granted bail by learned co-ordinate Benches of this Court through Cr. Misc. No.
79212 of 2019 dated 04.12.2019 & Cr. Misc. No. 53850 of 2019 dated 01.10.2019, respectively. While concluding the argument it is submitted that investigation has been completed, for which, charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.
7. In view of aforesaid facts and circumstances as mentioned above and by taking note of fact as save and except suspicion arising out of confessional statement of coaccused persons prima-facie nothing incriminating recovered/surfaced as to connect this petitioner prima-facie with the present crime in question, coupled with the fact as petitioner remains in custody since 05.04.2024, accordingly above named petitioner, is directed to be released on bail in connection with Dhanarua P.S. Case No. 111 of 2017 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Masaurhi at Patna/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
