IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Revision No.862 of 2016 ======================================================

1. Nirmala Kuar Wife of Late Bramdeo Singh, Resident of Dhantolia, P.O. and P.S.- Dehri, District- Rohtas.

.... .... Petitioner/s

Versus

1. The State of Bihar.

2. Arvind Kumar Singh son of Indradeo Singh, resident of Village- Nadh, P.S- Shiv Sagar, District- Rohtas (Sasaram).

.... .... Respondent/s ====================================================== Appearance :

For the Petitioner/s : Mr. Sumeet Kumar Singh, Advocate For the Respondent/s : Mr. Sri Ajay Kumar -2, A.P.P. ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-05-2017 The petitioner is aggrieved by an order dated 01.09.2015 passed in Sessions Trial No. 166 of 2006 arising out of Sasaram Town P.S. Case No. 65 of 2003 whereby his petition dated 21.09.2012 for re-examination of the petitioner as prosecution witness has been rejected.

This criminal revision application, in my view, is not maintainable since it has been preferred against an order which is interim in nature. Secondly, I am also of the view, from what has been recorded by the court below in the impugned order that the petitioner, for some reason or the other is trying to linger the trial. The conduct of the petitioner is deprecable.

This application is dismissed.

Patna High Court CR. REV. No.862 of 2016 (5) dt.02-05-2017 2/2 The trial court is directed to proceed with the trial. (Chakradhari Sharan Singh, J) Vats/- U T
