The petitioner seeks bail in anticipation of his arrest in connection with Industrial Area, Hajipur, P.S. Case No. 178/2017 dated 17.11.2017 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It has been alleged in the F.I.R. that on seeing the police party, two motorcycle borne youth left behind the motorcycle and ran away. On search, it was found that 20 litres of illicit liquor was being transported by the aforesaid motorcycle. The petitioner is sought to be prosecuted in the present case because he happens to be the owner of the aforesaid motorcycle which allegedly was used by the miscreants for carrying liquor.

The motorcycle of the petitioner has been seized. The

Patna High Court Cr.Misc. No.4720 of 2018 (2) dt.05-02-2018 2/2 petitioner denies of his having rode the motorcycle on the date of occurrence. The aforesaid motorcycle of the petitioner, it has been submitted, was given to somebody else, who had unauthorizedly carried liquor on the same.

Considering the aforesaid facts and also taking into account that the petitioner does not bear any criminal antecedent, he is directed to be released on bail, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned A.D.J. 2nd, Hajipur in connection with Industrial Area, Hajipur, P.S. Case No. 178/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
