2. The petitioner is in custody since 20.02.2024 in connection with Mairwa P.S. Case No. 161 of 2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act and Sections 279/427 of the Indian Penal Code.

3. As per the prosecution case, there is recovery of 43.600 liter of countrymade liquor.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case merely on the basis of suspicion. He further submits that the petitioner has no concern with the alleged recovery of illicit liquor.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.30339 of 2024(2) dt.21-06-2024 2/2 behalf of the State has vehemently opposed the prayer for bail.

Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. 1, Siwan in connection with Mairwa P.S. Case No. 161 of 2023.

7. The petitioner is directed to mark his attendance in Mairwa P.S. on 1st Sunday and 3rd Sunday of every month. Failure to do so, will result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Saif/- U T
