The heirs and legal representatives of opposite party No.2 Shanti Devi, who died on 20.11.2021 as mentioned in paragraph 2 thereof are directed to be substituted in her place and her name is expunged from the array of the parties.

I.A. No. 04 of 2022 The interlocutory application has been filed for substitution of heirs and legal representatives of petitioner no.2 Manohar Lal, who died on 03.09.2021.

For the reasons mentioned in this interlocutory

Patna High Court MJC No.2722 of 2008(7) dt.26-09-2022 2/2 application, it is allowed. The heirs and legal representatives of petitioner no.2, Manohar Lal as mentioned in paragraph 2 thereof are directed to be substituted in his place and his name is expunged from the array of the parties.

This application has been filed for restoration of F. A. No. 223 of 1986 which stood dismissed for non-compliance of the peremptory order dated 05.01.1996.

Learned counsel for the opposite parties has vehemently opposed the prayer of the petitioners. For the reasons mentioned in this application, it is allowed and F. A. No. 223 of 1986 is restored to its original file.
