In this case, petitioners are seeking anticipatory bail in connection with Araria (Mahila) P.S. Case No. 117 of 2016 corresponding to Special Case No. 27 of 2016, registered for the offence punishable under Sections-448, 341, 323, 354(B), 504/34 of the Indian Penal Code and Sections-7/8 of POCSO Act.
Allegation has been made that three persons in a Scorpio landed on the house of the informant and started molesting his daughter. When she objected the complainant was also misbehaved and abused. The accused persons wanted to kidnap her daughter but the informant herself came to rescue her daughter from their clutches. It is further alleged that the accused persons torn their clothes and made the informant and her daughter half naked. Counsel for the petitioners has submitted that all the allegations
Patna High Court Cr.Misc. No.6165 of 2018 (2) dt.05-02-2018 are false. There is a gap of eight days in lodging FIR without any explanation. The offence is alleged to have been committed at Forbesganj whereas the case has been lodged in Araria without any explanation. Looking into facts and circumstances of the case, let the petitioners namely, Ravi Kumar Yadav @ Ravi Kumar, Sachin @ Sachin Yadav, Devanand Yadav and Kiran Devi, be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge-cum-Special Judge, Araria in connection with Araria (Mahila) P.S.
