JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 23 of 2019 registered for the offence punishable under Section 30(A) of Excise Act. Allegation is of recovery of 25.500 litres of foreign liquor from the office of the PACS Chairman and it is said that petitioner succeeded in fleeing away.

Submission of learned counsel for the petitioner is that he has falsely been implicated and he has no connection with the PACS office and there is also no recovery either from his possession or from his house.

Heard learned APP also, who has opposed the prayer for anticipatory bail.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.27708 of 2019(3) dt.09-07-2019 2/2 petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District JudgeVI, Saran at Chapra, in connection with Excise Case No. 23 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
