JUSTICE BIRENDRA KUMAR ORAL ORDER 17-01-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in Kalyanpur P.S.Case No.153/16 for the offences under Sections 304(B), 120(B)/34 of the I.P.C.

The daughter of the informant died in her matrimonial house in an unnatural circumstance within six months of her marriage. The petitioners and others are alleged to have tortured for non-fulfillment of dowry demand which resulted in dowry death.

Submission of the petitioner is that in this case the case diary would reveal that since the husband of the petitioners

Patna High Court Cr.Misc. No.52423 of 2016 (3) dt.17-01-2017 2/2 was mentally ill. He was not liked by the victim as a result whereof she committed suicide by strangulating herself. There is no specific allegation against the petitioners. Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of A.C.J.M.
