JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 In the light of supplementary affidavit, learned counsel for the petitioner is permitted to make necessary correction in para- 3 of the petition.
Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 376 and 511 of the Indian Penal Code. It is submitted on behalf of the petitioner that the petitioner is in custody since 28.05.2016. Charge sheet has been submitted in this case. The police has found case true under Section 354 of the Indian Penal Code and Section 8 of POCSO Act. The petitioner and the informant are agnates and due to property dispute the present case has been instituted. The date of occurrence is 09.05.2015 and FIR is instituted on 04.07.2015. The
Patna High Court Cr.Misc. No.26271 of 2016 (3) dt.18-08-2016 2/2 delay has not been explained by the prosecution. On behalf of the State it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J-1,Sitamarhi in connection with Dumra P.S.Case No. 167 of 2015 (Tr. No. 07 of 2016).
