This application for regular bail arises out of Excise Case No. 181 of 2020, disclosing offence punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The prayer for grant of regular bail of these petitioners was earlier rejected by this Court by an order dated 22.12.2020, passed in Cr. Misc. No. 34056 of 2020, with an observation that they shall be at liberty to renew their prayer for bail after six months if, in the meanwhile, there was no substantial progress at the trial. Accordingly, this application

Allegedly, 164.160 litres of Indian made foreign liquor was recovered from a Tata Safari vehicle, which was occupied by petitioner No. 1 as driver. Petitioner no. 2 was found sitting in the vehicle.

Be that as it may, since the petitioners have remained in custody since 24.07.2020, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), each with two sureties of the like amount, each to the satisfaction of learned A.D.J.-II, Gopalganj, in Excise Case No. 181 of 2020.
