The petitioner has filed this writ petition against the order dated 12.05.1997 as contained in Memo No. 502 issued by Civil Surgeon-cum-Chief Medical Officer, Jehanabad (Annexure-1).

The petitioner was illegally appointed by Dr. A.A. Malick and all such appointees have already been dismissed from service. Such illegal appointees preferred the writ petition which was dismissed. Some of the illegal appointees filed C.W.J.C. No. 18447 of 2009, C.W.J.C. No. 18480 of 2009 and C.W.J.C. No. 18481 of 2009 and this Court vide order dated 26.04.2010 dismissed the writ petitions. Ashok Kumar, who was also illegally appointed, filed C.W.J.C. No. 12732 of 2009 and the same was dismissed on 15.12.2009. The case of the petitioner stands on the same footing as the petitioner was also illegally appointed by Dr. A.A. Malick.
