The petitioner apprehends his arrest in connection with Bachhwara Rail P.S. Case No.12 of 2021, registered for the offence punishable under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail

Patna High Court CR. MISC. No.27467 of 2022(3) dt.20-12-2022 2/2 application. It is submitted that the petitioner is said to have purchased the stolen mobile from a person and went to Hyderabad where he works. When the police reached his house, he came from Hyderabad and handed over the said mobile to the police. It is submitted that petitioner was granted benefit of Section 41(1) Cr.P.C.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the fact that petitioner has got no criminal antecedent, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Barauni, District Begusarai in connection with Bachhwara Rail P.S.
