JUSTICE SANDEEP KUMAR ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Mahindwara P.S. Case No. 77 of 2022 registered for the offence punishable under Sections 147, 148, 149, 323, 341, 342, 324, 307 & 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has got clean antecedent. Petitioner is in custody since 06.05.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation and also

Patna High Court CR. MISC. No.28956 of 2023(2) dt.24-05-2023 2/2 considering the period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Sitamarhi, in connection with Mahindwara P.S. Case No. 77 of 2022.
