JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 419, 420, 467, 468, 471, 120B/34 of the Indian Penal Code and sections 3, 4 and 10 of the Examination Act.

On the alleged date and time of the occurrence, in the first sitting of examination of Practice of Medicine, co-accused Jay Kumar was found taking exam in place of the petitioner. Learned counsel appearing for the petitioner submits that the petitioner never took part in the said examination and as a matter of fact, due to previous enmity, co-accused Jay Kumar had stolen his admit card to ruin his career. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.27288 of 2023(2) dt.11-07-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class Muzaffarpur in University Police Station Case No. 08 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
