The petitioner apprehends arrest in connection with Fatwah (Fatuha) P.S. Case No. 495 of 2009 dated 25.12.2009 instituted under Sections 366A/120/34 of the Indian Penal Code. After some arguments, learned counsel for the petitioner seeks permission to withdraw the application to surrender before the Court below and seek regular bail. Learned A.P.P. does not oppose.

In view of the aforesaid, the application stands disposed off as withdrawn with liberty aforesaid. In the event the petitioner surrenders before the Court below along with a copy of this order within one month from today and prays for regular bail, the same shall be considered on its own merits, in accordance with law, without being prejudiced by the
