The petitioner apprehends his arrest in connection with Town P.S. Case No.565 of 2016 registered under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

The accusation is that when the informant Gaurav Kumar was present his Telenor Show Room, at that time, two persons came there for replacement of SIM No.9122222222 and gave Voter ID Card in the name of Dauday Haqu Sayeed Khan. Due to that reason, the SIM was sent for replacement to Telenor Regional Officer. At about 12 Noon, when both persons came at his show room and made query about replacement of SIM, in that course, his Sales Head Danish Arman informed the informant that the said SIM is in the name of the father of

Patna High Court Cr.Misc. No.42379 of 2017 (2) dt.20-09-2017 2/2 his Head. On suspicion, an information was given to the Police station by them. On query, both boys disclosed their name as Gulshan Kumar and Chandan Kumar, who wanted to use the SIM after replacement on fake ID for illegal purpose.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is the Sales Officer of Telenor and due to misunderstanding, he has falsely been implicated in this case. In course of investigation, the name of the petitioner has been disclosed by the accused persons, named in the F.I.R., who had come to change the SIM. Now, the case has already been compromised and a compromise petition has also been filed by the informant. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Town P.S. Case No.565 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
