The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 353, 385 and 504/34 of the Indian Penal Code.
Allegation against the petitioners is of committing nuisance while the election of School Shiksha Samiti was going on.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioner No.1 is the Secretary of the Managing Committee of the School and petitioner No.2 is the
Patna High Court Cr.Misc. No.45446 of 2017(2) dt.22-09-2017 2/2 husband of petitioner No.1. It is further submitted that the petitioners are ready to deposit an amount of Rs.25,000/- in the court below, which shall be subject to the final disposal of the case.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners shall deposit an amount of Rs.25,000/- in the court below, which shall be subject to final disposal of the case and on doing so, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupari, Sitamarhi in connection with Pupari P.S. case No.204 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
