JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Simri P.S. Case No. 69 of 2016 for the offences instituted under Sections 401, 420/34 and 120(B) of the IPC. The prosecution story, in brief, is that on chase, the informant caught Laltoon @ Ajay Sahni. He disclosed the name of Monu Sahni. He also disclosed that this petitioner and Shyam Sahni purchased the Motorcycle from looted money. The informant recovered a motorcycle from the house of Laltoon Sahni and he also arrested this petitioner and recovered a motorcycle from his house.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.53455 of 2016 (2) dt.22-12-2016 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been named in the FIR on the basis of disclosure made by the co-accused Laltoon Sahni. The Motorcycle which is alleged to have been recovered from possession of the petitioner has already been released in favour of the mother of the petitioner. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Simri P.S. Case No. 69/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Darbhanga, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. U.K./- (Sudhir Singh, J) U T
