In this case, the petitioner is seeking anticipatory bail in connection with Derni P.S. Case No.98 of 2017, registered for the offence punishable under Section 376/34 of the Indian Penal Code.

As per the statement made by the victim, where she has stated that on 18.02.2017 in the evening at 7 o'clock she had gone for natural call, at that time, Mithilesh Kumar Rail came and he took her to the different places and both have reached to Kolkatta, there they stayed and later on, Vikash Kumar also joined and both have forcibly established physical relationship with her. As there is no specific allegation against the petitioner, let the petitioner, namely, Ram Nath Rai, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M., VII, Saran, Chapra, in connection with Derni P.S. Case No.98 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
