2. Permission is accorded.

3 . This bail petition of petitioner No. 6 is dismissed as withdrawn .

4. Heard learned counsel for the petitioner No. 1 , 2, 3 , 4 and 5 and the State .

Patna High Court CR. MISC. No.27016 of 2025(2) dt.06-05-2025 2/3 5 . Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 109 (1), 74, 352, 351 ( 2 ) and 3 (5) of the BNSS.

6. As per F.I.R., allegation against these petitioners is that they assaulted informant, his son , nephew and his son -in -law with axe due to which they sustained injuries. Injury sustained by informant is grievous in nature .

7. It is submitted on behalf of the petitioners that specific accusation of assault to informant is against co-accused Bhairo Rajak . So far as these petitioners are concerned, they are alleged to have assaulted other family members of informant. Doctor has found the injury simple in nature . Petitioners claim clean antecedent.

8 . Learned counsel for the State oppose the bail petition .

9. Considering the nature of injury , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners Nos. 1 , 2, 3 , 4 and 5 as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Banka in

Patna High Court CR. MISC. No.27016 of 2025(2) dt.06-05-2025 3/3 connection with Katoriya P.S. Case No. 260 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
