JUSTICE BIRENDRA KUMAR ORAL ORDER 16-11-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 47(A) of the Bihar Excise (Amendment) Act, 2016.

Husband of the petitioner is also accused in this case. He is already in custody as submitted by the learned counsel for the petitioner. Liquor was recovered from the house of the petitioner on 20.07.2016.

Considering the fact aforesaid as well as the fact that the petitioner is a female and she has stated on oath that she has no criminal antecedent, the petitioner, above named, is

P.S. Case No.201 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
