The petitioners apprehend their arrest in Ramgarh P.S. Case No. 68 of 2016 registered for the offences punishable under Sections 304B and 201 of the Indian Penal Code. The informant filed Complaint Case No. 512 of 2007 on the basis of which the present FIR was registered on 20.04.2016. The informant alleged that his niece Babita Devi was married to Binod Paswan on 27.05.2002 but the accused persons were torturing her. On 21.04.2007 her niece was burnt to death by the accused persons.
It is submitted that the occurrence is said to have taken place on 21.04.2007 but the complaint petition was filed on
Patna High Court Cr.Misc. No.26944 of 2016 (3) dt.02-09-2016 2/2 10.05.2007 and the FIR was lodged after nine years from the date of lodging of the complaint petition. The informant did not make any specific allegation against the accused persons who are fatherin-law, mother-in-law and sister-in-law of the deceased. Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in in Ramgarh P.S. Case No. 68 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
